Consumer Groups Demand Investigation into Effects of T-Mobile/Orange Merger


The proposed Orange/T-Mobile merger is facing a lot of criticism from consumer groups that are now demanding for a fresh investigation into the impact of the merger on competition in the UK mobile market.

In a letter addressed to the competition commissioner of Brussels, the two groups - Communications Consumer Panel (CCP) and Consumer Focus - have asked the competition authority to carry out an investigation into the matter following the recent comments aired by consumer organization Which?, focussing on the necessity for such an investigation.

The letter draws the attention of authorities to the hotly debated issues of spectrum allocation and the formation of an entity with a huge spectrum in addition to the issue of decline in healthy competition with respect to the expanding 3G technology. It also brings forth the new debate on UK’s MVNOs (mobile virtual network operators) and the impact of merger on them as they do not own a network of their own but provide services based on leased capacity.

CCP and Consumer Focus are aiming at getting the merger decision shifted from Brussels to the British authorities, who in turn will hand it over to the Office of Fair Trading and the Competition Commission for further investigation. Though this would make the decision making process longer and lengthier, the groups suggest that this is the right way.

The letter also said that for assessment of the real effects of the merger, a national review on these lines should be carried out by the authorities.
